Leody de Guzman, BMP President, added, “Two presidents invoked and used Emergency Powers: Fidel Ramos, when he used it and locked-in the country in IPP contracts that to this day the Filipino people are paying for in high electricity rates; and Gloria Arroyo, when she wielded emergency powers to preserve her fraudulently acquired presidency in the 2004 elections. During both times, emergency powers did not serve the people’s interest and welfare at all.”</div>

Laban din ang mga nasabing grupo sa Economic ChaCha, na pinangungunahan ni House Speaker Sonny Belmonte. Inilarawan ni Sonny Melencio, pangulo ng PLM, ang kilos upang ipasok ang pariralang “and as provided by law” hinggil sa pagpayag sa 100% pag-aari ng dayuhan sa Pilipinas bilang “pagtatangkang bigyan ng libreng pases ang mga dayuhang korporasyon na was akin ang likas-yaman at lakas-paggawa ng bansa nang walang anumang katiyakan na ito’y magbibigay ng benepisyon sa buong mamamayan, at hindi lang sa mga pabrika sa export processing zones at sa mga tahanan ng uring maraming pag-aari”.</div>

The Pagkakaisa ng Manggagawa sa Transportasyon (PMT) and Bukluran ng Manggagawang Pilipino (BMP) will organize a picket in front of the LTFRB office in Quezon City tomorrow, February 19. The protest coincides with the regulatory agency's first hearing on the Bontoc bus tragedy that claimed lives of 14 passengers including cultural activist and comedian Tado Jimenez.<br />

Larry Pascua, PMT secretary-general said, "We are calling for reforms in the transport industry in the light of the recent Bontoc and Skyway tragedies, involving the Florida and Don Mariano Marcos bus lines. Strict government regulation must be placed to ensure the safety of the commuting public, who must not fall prey to unscrupulous methods of profiteering".<br />

Pascua added, "In developed countries, safety measures are strictly enforced both in state-owned and privatized mass transportation systems. Vehicles, machines and instruments used in public transport should conform to government standards. More so, transport workers must enjoy sufficient wages and benefits, shorter working hours and humane conditions of work. They do not hesitate to invest on safety because life is more precious than property".<br />

At the protest, transport workers, cause-oriented groups and supporters of the late Tado Jimenez carried placards that read: "Regulasyon, hindi korapsyon sa transport industry", "Kaligtasan muna bago tubo ng kapitalista", "Hustisya para kay Tado at lahat ng biktima".<br />

To conclude, Ronnie Luna, vice-president of Bukluran ng Manggagawang Pilipino (BMP) asked, "How many more innocent lives have to be lost to a poorly-regulated, profit oriented transport system? How long will we endure badly-maintained vehicles that continue to threaten the lives of the people? The rightful answers to these questions are not terms of money, sales and costs. In a public presentation for transport groups held today at the UP Diliman School of Economics, the Independent Oil Price Review Committee (IOPRC) refuted claims that petroleum products in the country where unfairly priced as they exonerated oil companies from allegations of amassing excessive profits. The body also said they saw “nothing extraordinary” with local fuel price movements noting responsiveness to world market price changes. </div>

Meanwhile, members of the Pagkakaisa ng Manggagawa sa Transportasyon (PMT) and allied organizations protested outside to condemn what they called “pre-fabricated and bogus findings and recommendations by the committee”. According to them “the self-professed independent body turned out to be another instrument to cover up abuses being perpetrated by oil companies and defend the bankrupt oil industry deregulation policy. The only “good thing” to come out of this shenanigan is that it exposed, once again, the collusion between government and oil companies to cause the suffering of the Filipino masses.”</div>

“We are not surprised. We have heard such conclusions time and again from Sec. Almendras and his predecessors at the DOE. What would you expect from a body created, tasked and funded by the DOE?” said Roger Javinal PMT spokesperson. </div>

“But we are dismayed with the esteemed members of the IOPRC for allowing themselves to be used as dummies to justify the exploitation of oil companies and rationalize the inaction of their cohorts in government. We had expected more from them, specially Prof. Diokno.” continued Javinal.</div>

“To find the oil deregulation policy successful in promoting fair prices by the simple increase in the number of companies who sell petroleum products in the country is garbage and an utter insult to the Filipino people’s intelligence. The high-faluting way the IOPRC presented its findings and recommendations, without caution of probable illusions, false-relationships and biases the techniques or approaches employed may lead to, smacks of dishonesty and deception,” explained Larry Pascua, PMT Secretary General and representative to the public presentation.</div>

“How can they say that that there was no overpricing and profiteering when they did not even get to study the real price of oil based on production costs, when they did not even get to scrutinize inventory data and supply contracts of local companies and their dummies, when they did not bother to delve into the dynamics of international monopoly corporations? Aside from these necessary issues, the body completely disregarded public welfare in the conduct of the review, to us the only acceptable bias. Prof. Diokno is even quoted recommending the deregulation of public transport to allow them automatic fare adjustments callously declaring that a monthly P.50 increase in fare won’t be too much of a burden. Such statements make us think that maybe this stint with the Almendras committee made him and the rest of the members for life?” added Pascua.</div>

“These findings and recommendations are unbelievable and unacceptable. Illusions peddled by this administration of a “tuwid na daan” and “kayo ang boss ko” governance continue to erode. The only real and meaningful change can only come from the masses’ direct political action. We will continue to protest against fuel products overpricing and profiteering. We will continue to demand for the scrapping of the oil deregulation law and VAT on oil products," concluded Pascua.</div>

Militant transport workers from the <b>Pagkakaisa ng Manggagawa sa Transportasyon (PMT)</b> demonstrated outside the compound of the Department of Energy (DOE) to call on the newly-formed Oil price Independent Review Committee (IRC) to put public welfare above oil companies’ profits as they investigate whether or not oil prices are overpriced and oil companies have abused the Oil Deregulation Law.</div>

The PMT welcomed the creation of the IRC but warned against staging the review to justify the continued implementation of RA 8479 or Oil Deregulation Law. They asked the personalities who have agreed to be part of the IRC to conduct an honest examination of the documents to be provided by oil companies and operation of the industry under a deregulated environment with the view of protecting the masses’ interest and welfare.</div>

According to the PMT the enactment of RA 8479 in 1998 only bolstered the control of the Big 3 over the country’s oil industry. The absence of government role in oil pricing set the stage for rampant overpricing and profiteering as oil companies respond quickly and more fully to upward international price movements while being slow and unresponsive to decreases. In 2005, instead of going against such trend, government joined the bandwagon by imposing the Value-Added Tax on petroleum products. Together, VAT and deregulation has devastated the lives of our transport workers and the masses, in general.</div>

“13 years of bitter experience with oil industry deregulation is enough proof for the IRC to propose the scrapping of RA 8479 and also the VAT on oil products. In fact, globally, deregulation and the whole neo-liberal agenda has failed to the secure the lives of the working masses while concentrating wealth to a very small minority. The first and foremost consideration of the IRC in the conduct of the review must be public welfare unless they want to challenge the ire of impoverished people. In a letter to the Department of Energy, Petron Corp. chairman Ramon Ang made the proposal in order for government to have the means to address the issue of rising fuel prices. He likewise made their retail stations available for re-sale if deemed necessary.<br /><br />Pnoy has rejected the offer. Saying “at this point in time it will not be in the best interest to people if government were to re-run Petron.” He also added “it will only lose money” and “inefficient pag government nagpapatakbo something that has purely business applications.”<br /><br />Pnoy completely misses the point. He was outclassed by Ang. And once again, his impromptu statement exposes his utter incompetence and insincerity in addressing the issue of rising oil prices.<br /><br />The reversal of Petron’s privatization is neither about business nor profit.<br /><br />A government controlled Petron will not lose money if managed professionally. The practice of turning government corporations into appointees’ playgrounds and milking cows must be stopped.<br /><br />Petron controls 38% of the local market. Petron’s refining capacity is 180,000 barrels per day. Control over this company will allow government to check the unscrupulous practice of oil firms in implementing oil price hikes, overpricing and price manipulation. A State Operated Enterprise (SOE), such as this case, will not be operated on the basis of profit-making like any other business, but of social welfare maximization.<br /><br />By this, Petron in government hands must be made to assume the lead in the local oil industry in terms of pricing, quality and technology. Tinututulan nila ang outsourcing - isang iskemang iligal at sumisikil sa karapatang security of tenure.</div><div style="text-align: justify; "><br /></div><div style="text-align: justify; ">Kasalukuyang nasa Court of Appeals ang kaso. Pero bago ito humantong sa Korte, si Lucio ay pinaboran ng DOLE at ng Malakanyang.</div><div style="text-align: justify; "><br /></div><div style="text-align: justify; ">Mismong si P-Noy ay nagdeklarang kakasuhan daw ng mga abogado ng Palasyo ang mga manggagawa. Economic sabotage daw ang nangyaring pagkakansela ng mga flight ng PAL. Pero ano ba ang ginawa ng unyon (PALEA)? Sila ay nagprotesta sa pagkakatanggal sa trabaho. Bakit nakansela ang mga flight? Dahil sa ginawang pagtatanggal ng PAL management! Sino ngayon ang nananabotahe?</div><div style="text-align: justify; "><br /></div><div style="text-align: justify; ">Ang ikalawang kaso ay ukol sa retrenchment ng 1,400 myembro ng Flight Attendants and Stewards Association of the Philippines (FASAP). Nanalo na ang mga manggagawa sa kasong ito. Umabot na sa ikalawang dibisyon ng Korte suprema - matapos ang 13 taon na mahabang proseso ng talo't panalo - ng apela at kontra-apela mula pa sa "mababang korte" (National labor Relations Commission o NLRC).</div><div style="text-align: justify; "><br /></div><div style="text-align: justify; ">Sa desisyon ng 2nd division ng Korte, umabot na sa ikatlong Motion for Reconsideration. Kahit pa noong desisyunan ang kaso - pabor sa FASAP - sinabi nitong ang desisyon ay "final and executory". Pinal na at hindi na papakinggan pa ang anumang apela dito.</div><div style="text-align: justify; "><br /></div><div style="text-align: justify; ">Pero sa isang iglap, kahit tatlong beses nang paboran ng Korte, muling nabuksan ang kaso matapos lamang silang sulatan ng abogado ng PAL (si Estelito Mendoza ng counsel ni Erap sa impeachment case). Kaya ngayon, nakabinbin muli ang kaso sa buong mahistrado (Supreme Court en banc).</div><div style="text-align: justify; "><br /></div><div style="text-align: justify; ">Bakit ganito kalakas si Lucio Tan sa Korte Suprema? Hindi ba't ang hustisya ay may piring sa mata upang hindi siya "masilaw sa yaman" ng nagkakaso o kinakasuhan? At hindi ba't ayon mismo kay Erap, si Lucio Tan ang nagpasok kay dating Chief Justice Davide sa Korte?</div><div style="text-align: justify; "><br /></div><div style="text-align: justify; ">Natutukso tayong magduda. Tila sumusunod ang Korte sa ginawang "kontra-manggagawang" tindig ni P-Noy sa kaso ng PALEA. More than 100 trucks, buses, jeepneys and private vehicles snarled traffic along the NLEX as protesters asked P-Noy to stop the imposition of the VAT on toll fees. </div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">On October 1, 2011 toll fees rose by 12% as toll ways operators started collecting the value-added tax (VAT). This will inevitably result to a domino effect on prices of basic commodities and services.What makes it worse according to protesters is that the punishment will increase over time. Toll ways contracts allow for yearly increases in toll fees.This meant more VAT revenues for government at the expense of the people.</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">For Class 1 motorists (cars, jeepneys, vans and AUVs) of the NLEX are charged an additional P1-23; Class 2 (light trucks and buses) an additional P3-58 and Class 3 (trailers and large trucks) an additional P4-69depending on entry/exit point. For the SLEX, Class 1 motorists arebe charged up to an additional P10; Class 2 up to an additional P20 and Class 3 up to an additional P30. The SCTEX, STAR and Skyway toll fees increased similarly.</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">PMT Secretary General, Larry pascua exclaimed, “We already have our backs bent and bowls begging from the debilitating effects of exorbitant prices of petroleum products, power rates as well as high prices of basic commodities and services. Malacanang’s persistence in collecting VAT on toll shows its apathy and callousness to the plight of our overburdened people.”</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">Calls to stop the implementation from various sectors and other government officials fell on deaf ears as Malacanang insisted that it was left with no other choice but to collect the VAT after the Supreme Court lifted the Temporary Restraining Order and affirmed the legality of the VAT on toll. Government expects VAT revenues to increase by 2 billion pesos as result of this.</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">Pascua explained“It is not true that the SC decision ordered the Malacanang to collect the VAT. It merely declared legal the imposition of VAT but at the same time stated that “the exclusive discretion on the implementation of tax measures lies with executive department”. The failure to paralyze transport? Or government failure to address spiraling oil prices and its paralysis on the people’s demand for oil regulation, a bigger and substantial rollback, and the removal of VAT on petroleum products?</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;"> </div><div style="text-align: justify;">Infinitely much worse is a government that is a willing and able accomplice to unjust and immoral profiteering by the oil industry. A government, which does not lift a finger to bring down oil prices because it collects more taxes, through VAT, in as much as prices increase in a deregulated market. </div><div style="text-align: justify;"><br /></div><div style="text-align: justify;"> </div><div style="text-align: justify;">Was the recent “transport strike” a success or a failure? How do we measure a success of a strike (be it in transportation or in factories)? First, a strike must be able to paralyze the operations of a business. Second, as a consequence of the stoppage in the circulation of capital, the management gives in to the demands of the strikers, which could either be a partial or full concession to them.</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;"> </div><div style="text-align: justify;">Using these two conditions, we could say that the so-called “strike” was a failure. Even before September 19, the PMT knew that organized groups in the transport sector have not mustered enough strength and conviction to paralyze transport. In so doing, we called for a nationwide protest, not a strike, for the regulation and control of the oil industry. </div><div style="text-align: justify;"><br /></div><div style="text-align: justify;"> </div><div style="text-align: justify;">This “mistake” of PISTON and Mateo is not a costly one; and could be justified. They probably used the term “transport strike”, more for propaganda than an actual call to paralyze transport, in order to highlight a just and moral demand that needs more attention in the mainstream media. </div><div style="text-align: justify;"><br /></div><div style="text-align: justify;"> </div><div style="text-align: justify;">However, we openly declare that the so-called “transport strike” was a success. It popularized, on a nationwide scale, the demand to remove VAT on oil prices and to control oil prices. Because even the commuting public viewed the protests not as a nuisance but a legitimate expression of their discontent and disgust against the scandalous profiteering by oil companies.</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;"> </div><div style="text-align: justify;">Hence, we view the nationwide protest as a “break in”, a warm-up for an actual paralysis of transport in the coming period. Ang patakarang deregulasyon ay nagaalis lamang ng kontrol sa pagpepresyo ng mga produktong petrolyo na walang pagsasaalang-alang sa kapakanan ng manggagawa’t mamamayan. Ang patakarang deregulasyon ay nagsisilbi lamang upang mas lalo pang palakihin ng mga kumpanya ang kanilang kita o tubos. Ang deregulasyon ay pagtalikod ng pamahalaan sa responsibilidad niya sa taumbayan.<o:p></o:p></span></p> <p class="MsoNormal" style="text-align: justify;"><span lang="EN-PH">Maliwanag na sa 13 taon sa ilalim ng deregulasyon sumambulat ang presyo ng produktong petrolyo sa bansa. 400%-500% na ang itinaas ng presyo ng produktong petrolyo sa bansa samantalang ang pinagbabatayan nilang presyo sa pandaigdigang merkado ay tumaas lamang ng 250%. Maliwang ang pagmamalabis na ginagawa ng mga kumpanya ng langis sa bansa. Nagagawa nila ito dahil protektado sila ng Oil Deregulation Law. Nagagawa nila ito dahil hindi kumikilos ang pamahalaan para sa kapakanan ng masa Pilipino at piniling magkubli sa likod ng Oil Deregulation Law. Yes, a policy review is necessary not to determine if deregulation causes an increase in oil prices; but to seek measures on how to shift the oil industry back to a regulated market. </div><div style="text-align: justify;"><br /></div><div style="text-align: justify;"> </div><div style="text-align: justify;">The promised Malacanang review of oil deregulation is useless and futile; like a fireman telling a tenant of the need to study the effects of water on fire before rescuing his burning house.</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;"> </div><div style="text-align: justify;">Palliatives to douse water on a brewing transport strike. Yesterday’s dialogue was enough to conclude that Noynoy will remain deaf to the clamor for government control of oil prices, a pressing need not just of the transport sector but of the entire Filipino people. This conclusion is based on two premises: (1) the inutile review of deregulation rather than a study to revert to a policy of regulation, (2) the proposed part two of the Pantawid Pasada Program, the use of alternative fuel, and the abuse of “kotong” cops on transport workers. </div><div style="text-align: justify;"><br /></div><div style="text-align: justify;"> </div><div style="text-align: justify;">Rather than focus on the pressing issue at hand (the reversal of the oil deregulation law), Aquino proposed measures that would not even lift an ounce in the burden of oil price hikes. This is an abomination. Local oil companies are clearly using speculative oil price news to cheat the Filipino people. We, however, look forward to joining hands in the next few weeks as we fully understand that only through a sustained, united, broad and nationwide campaign can we really achieve our goals.</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">We take exception to warnings voiced out by Malacanang that such mass actions by transport workers are illegal (specially when effective) and will result to the revocation of franchises. Such scare tactics will not cow us into giving up our rights specially now when government is virtually doing nothing to help.</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">The discounts being offered by the government is not enough to alleviate the plight of transport workers in this time of grave crisis. The discounts amounting to P1,800 for buses, P1,050 for jeepneys and P180 tricycles per month will only be good for 60-65% of the average monthly fuel consumption. Besides, these discounts will still be sourced from the VAT.</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">The PMT maintains that in order for government to provide relief to transport workers and resolve skyrocketing prices of petroleum products in the country, it must:</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">1. Rollback local prices of fuel to December ’10 levels and stop (freeze) any further price increases. We believe that there is no reason for local oil companies to increase prices despite the increase in world trade futures prices due to unrest in the Middle East and North Africa.</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">2. Remove the Value Added Tax on all petroleum products. This will result to further rollback in prices by at least P5. This will also be across-the-board meaning other sections of the transport industry (trucks, taxicabs, vans, AUVs, civil aviation, marine transport, etc.) will also be given relief.</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">3. Undertake government-to-government supply deals with nearby oil producing countries (Indonesia, Malaysia) or countries known to supply cheaper oil (Venezuela). This way, supply worries, which lead to speculative increases, will be eased.</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">4. Direct local oil companies to open their books to public scrutiny. With this we can surely prove that oil companies have manipulated prices of petroleum products in the country.</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">5. Repeal the Oil Deregulation Law. The past 23 years under deregulation is proof that it will not stabilize, much more lower prices of petroleum products. It only serves to strengthen the local oil cartel and allow oil companies to extract great profits at the expense of the Filipino people.</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">We call on transport workers and all poor working masses to unite. </div><div style="text-align: justify;"><br /></div><div style="text-align: justify;"><b>Scrap the VAT on oil products!</b></div><div style="text-align: justify;"><b><br /></b></div><div style="text-align: justify;"><b>Junk the Oil Deregulation Law!</b></div><div style="text-align: justify;"><br /></div>Unknownnoreply@blogger.com0
